ÉTICA DO DISCURSO: UMA TENTATIVA DE FUNDAMENTAÇÃO DOS DIREITOS BÁSICOS

Resumo

Este artigo é dedicado à análise e critica da concepção de direitos básicos fornecida por Habermas em Faktizitat und Greltung. Para tal, pretendo fornecer uma análise do princípio do discurso no discurso de fundamentação (Begründungsdiskurs), e a partir dai esclarecer a relação entre moral e direito, direitos básicos e direitos positivos em Habermas. Em seguida, pretendo desenvolver uma critica à teoria do discurso, e verificar a possível extensão da mesma ao discurso de fundamentação do sistema legal, e, mais especificamente, à fundamentação dos chamados direitos sociais básicos.

Abstract: This article is dedicated to the analysis and critique of the concept of basic rights provided by Habermas in Faktizitat und Greltung. To this end, I intend to provide an analysis of the principle of discourse on grounds of speech (Begründungsdiskurs), and from there to clarify the relationship between morality and law, basic rights and positive rights in Habermas. Then intend to develop a critique of discourse theory, and check the possible extension of this approach to speech grounds of the legal system, and more specifically, the reasoning of so-called basic social rights.
