APLICABILIDADE E EFICÁCIA DA NORMA CONSTITUCIONAL

Resumo

É na Constituição que se expressa, por excelência, o projeto básico da comunidade política nacional. Ela tende, por isso, mais que as outras leis, a um elevado nível de idealização. É certo, porém, que a articulação normativa dos desejos políticos, embora seja condição necessária para uma ação eficaz e obediente ao estado de direito, não basta, só por si, a promovê-la. De outro lado, a ilimitação das aspirações que se manifestam no texto constitucional pode, ao contrário, conduzi-lo à irrealizabilidade. Sem matar a utopia, indispensável a qualquer expressão normativa do direito, a Constituição deve conter-se nos limites do posssível. Ainda assim, sem determinação política para dar-lhe cumprimento, ela será antes causa de frustração que fonte de justiça, segurança e progresso.

Abstract: It is in the Constitution that the basic design of the national political community appears in particular. More than other laws, the Constitution tends, therefore, to a high level of idealization. However, the legal formulation of political wishes, although a necessary condition, is not, alone, able to promote actions which are both efficient and observant of the law rules. On the other hand, the unboundlessness of the aspirations which come to light in the constitutional text, may, on the contrary, be an obstacle to its feasibility. Without killing the utopian goals, essential to any general expression of the law, the Constitution has to contain itself within the limits of the possible. But even so, without the political determination to carry it out, it will be a cause of frustration rather than a source of justice, security and progress.
