Resumo

O presente artigo versa sobre a necessidade da ordem jurídica para a realização do bem comum no pensamento político de Tomás de Aquino. Assim, exploram-se inicialmente as noções de bem comum e de civitas, no interior da qual aquele bem se realiza; depois, num segundo momento, aborda-se a necessidade da ordo iustitiae, entendida como ordem jurídica, à realização do bem comum da comunidade política. Por fim, conclui-se, conforme a interpretação de Finnis, apresentando as características que teria esse sistema jurídico.

ABSTRACT: This paper discusses on the need of law for the realization of common good in the political thought of Thomas Aquinas. Thus, initially it explores the notions of the common good and civitas, inside which that right is realized. Then, at a second time, addresses the need of the ordo iustitiae, understood as legal order, to the realization of common good of political community. Finally, it is concluded as the interpretation of Finnis, presenting the features that have this system legal.
